Although not often talked about anymore, the Bosnia and Herzegovina electoral law remains one of the priorities on Bosnia and Herzegovina’s path to EU accession.

State Minister for Justice Davor Bunoza stated this to Avas, stressing that the Election Law and the Constitution of Bosnia and Herzegovina must be amended due to the decisions of the European Court of Human Rights in Strasbourg as well as the Constitutional Court of Bosnia and Herzegovina, and the amendments to the Election Law of Bosnia and Herzegovina imposed by High Representative Christian Schmidt leave this possibility open.
——The Ministry of Justice of Bosnia and Herzegovina previously submitted to the Council of Ministers of Bosnia and Herzegovina a proposal for amendments to the Electoral Law, drafted by a special working group appointed by the Council of Leaders. Bnosa recalled that the changes were mainly related to technical integrity and the implementation of the ruling of the Constitutional Court of Bosnia and Herzegovina, while also mentioning the obligation to amend the Electoral Law in accordance with the opinion of the European Court of Human Rights.
The proposal was withdrawn from the agenda due to a lack of agreement among government partners, but the obligation remains, as the judgments of the Strasbourg Court and the Constitutional Court of Bosnia and Herzegovina must be implemented.

– It is necessary to ensure that everyone in Bosnia and Herzegovina, and I mean the rest of the entire territory of Bosnia and Herzegovina, as well as Croats and Bosniaks in the Republic of Serbia, Serbs in the Federation of Bosnia and Herzegovina, realize their fundamental human rights, namely the right to vote and be elected to all levels of government. Also, in accordance with the position of the Constitutional Court of Bosnia and Herzegovina on the legitimate representation of the constituent peoples, ensure the principle of protection of the vital interests of the constituent peoples, without any abuse of power – stressed Brnoza.

He added that all these issues have been raised and the Ministry of Justice will soon set up a working group.
– We are currently developing the law on the Supreme Judicial Council of Bosnia and Herzegovina and the Court of Bosnia and Herzegovina, but I hope that by the end of this year we will raise the issue of the implementation of the decisions of the European Court of Human Rights and the Constitutional Court of Bosnia and Herzegovina – Minister Bnoša added.
