On August 1, an executive order banned the religious party Jamaat-e-Islami and its student wing Islami Chhatrashibir. Within four days, the then rulers collapsed in the face of the August 5 movement. It is said that in the change of power, the ban on Jamaat-Shibir was also lifted. Although there were rumors of an order in this regard in the past few days, it did not happen today (Tuesday).
This was confirmed when speaking to multiple sources at the Ministry of Interior on Tuesday evening (August 27).
Sources said that the withdrawal of the order banning Jamaat is in progress. The file is still kept with the Home Ministry till now. The file is likely to be submitted to the Law Ministry tomorrow, Wednesday, based on the opinion of the Home Advisor. Thereafter, the matter will be gazetted after the Chief Advisor takes the final decision.
Earlier, the Ministry of Home Affairs’ public security department issued a notification on August 1, banning Jamaat.
The notification stated that since the International Criminal Court’s judgment in several cases, the Bangladesh Islamic Congress Party (formerly known as Jamaat-e-Islami/Jamaate-e-Islami Bangladesh) and its affiliated organization Bangladesh Islami Chhatra Shibir (formerly Islami Chhatra Sangh) have committed genocide and war crimes during the 1971 Liberation War and have been held responsible for crimes against humanity; whereas, the High Court Division Bench of the Supreme Court of Bangladesh in its judgment on Petition No. 630/2009 dated August 1, 2013 cancelled the political party registration granted/obtained by the Election Commission to the Bangladesh Islamic Congress Party, and the Appellate Division of the High Court of the Supreme Court of Bangladesh upheld the judgment; whereas there is sufficient evidence in the possession of the Government that the Bangladesh Islamic Congress Party and its affiliated organization Bangladesh Islami Chhatra Shibir have been directly and indirectly involved in the recent killings, sabotage and terrorist activities.
It also stated that since the government considered that Bangladesh Jamiat-e-Islami and all its constituent organisations, including Bangladesh Islam Chhatra Hibir, were involved in terrorist activities, the government, under the powers conferred under Section 18(1) of the Anti-Terrorism Act, 2009, declared Bangladesh Jamiat-e-Islami and Bangladesh Islam Chhatra Hibir and their affiliates as banned political parties and organisations and listed all their affiliates, including Bangladesh Jamiat-e-Islami and Bangladesh Islam Chhatra Hibir, as prohibited entities in the Second Schedule of the Act. It will come into effect immediately.
