The Ministry of Culture and Media announced that they will conduct an inspection on their own initiative into the recording of the video “Heart of Serbia” because, according to them, they did not receive a request for permission to record the video, in which foreign producers violated several laws in the cultural field, which provide for the procedure in specific cases.
As they say, the Ministry of Culture and Media did not receive a request for permission to shoot the video “Heart of Serbia”, which means that the foreign producer violated several laws in the cultural field, which regulate the procedure in this case. Therefore, the Ministry will send an initiative to the Inspection Service to carry out inspection supervision.
As announced by the ministry, the Ministry of Culture and Media was not aware of the production of the “Heart of Serbia” video, as no official request was sent to the foreign producer to shoot the aforementioned film production on the territory of Montenegro. The foreign producer did not file a request either to the ministry or to the Directorate for Protection of Cultural Property to use cultural property for special purposes, indicating that the foreign producer violated several laws in the field of culture, which provide for specific procedures in cases.
To this end, the Ministry of Culture and Media will proactively issue a proposal to the Inspection Affairs Bureau to inspect and supervise the implemented actions that have not been approved by the competent authorities.
The Ministry of Culture and Media clarified that event organizers have a legal obligation to contact the Cultural Property Protection Bureau regarding the above-mentioned recordings, as Article 58 of the Cultural Property Protection Law clearly stipulates that cultural property or its identifiable parts may be used in advertising, as a component of a company, in the production of souvenirs, film or photographic materials or for other commercial purposes with the approval of the competent authorities, but their integrity shall not be damaged.
“In our communication with the Cultural Property Protection Bureau, we received the message that no one has addressed this issue.”
According to the Law on Cinematography, foreign producers are obliged to submit a request to the Ministry of Culture and Media to shoot a cinematographic work on the territory of Montenegro, and according to Articles 21 and 22, foreign producers may shoot a cinematographic work on the territory of Montenegro independently or in cooperation with domestic and foreign co-producers with prior approval of the Ministry. Since no request has been formally submitted, we remind you that foreign producers are obliged to submit a request to the Ministry of Culture and Media to shoot a cinematographic work on the territory of Montenegro,” the Ministry of Culture and the media said in a statement.
The department explained that the request for approval should contain the subject, the name of the foreign producer, the title of the film work and information on the author team, the location and time of filming, as well as information on the employment of domestic or professional personnel and equipment.
“In addition, foreign producers are obliged to submit upon request the complete script of a cinematographic work, i.e. the parts marked in the script text, according to which it is to be filmed in Montenegro, as well as the contract of cooperation with a domestic co-producer, the declaration of the foreign producer or domestic co-producer, which stipulates their obligation to submit a copy of the film to the Film Archive in accordance with Article 18 of the Law on Cinematography, which stipulates the obligation of foreign producers to submit a copy of the film to the Film Archive. Cinematographic works shot in the territory of Montenegro within 12 months after the completion of shooting (i.e. within 6 months after the completion of post-production by the Ministry of Culture and Media).
They pointed out that, taking into account all the above, the activities carried out during the filming of the “Heart of Serbia” video were not carried out in the manner provided for by the previously cited legal provisions and, in fact, constituted a misdemeanor in accordance with the provisions of this Law. Our Agency sent a motion for inspection and supervision to the Directorate of Inspection Affairs in order to take measures and actions within its jurisdiction.
