televisionTechnically speaking, you are right that Chief Justice Sakoane Sakoane should rule on your civil case against the corrupt, shameless and despicable member Thejane Thejane for stealing M262 000 from his poor client “M’e ‘Matšepang Setala”.

With a civil court order you were able to seize Tejane’s assets and recover Mrs Setala’s money. But it later transpired that Thejane’s bank account (which you as the Lesotho Bar Association successfully helped freeze in another court decision) only had M4 maloti?

Yet, you have failed to state in your application on behalf of Ms. Setala whether Thejane has any other assets that could be seized? Greedy crooks like him usually don’t have any assets. That’s why they resort to stealing. That’s why Ntate Sakoane also failed to understand the significance of your application.

How are you going to explain to Mrs. Setara that after all her efforts, she could only get 4 malotis out of the 262,000 Maldivian rupees stolen by the scumbag Thejane?

For Scrutator, it is easy to understand why CJ Sakoane was furious about your application and why he claimed that you were falsely raising the hopes of this poor woman by making her think that you could help her get her money back?

So while you are right that a case can involve both civil and criminal elements and both must be decided, and while you are right that the court cannot force a litigant to withdraw but can only decide the case, we would do well to leave these legal technicalities aside.

CJ Sakoane rightly admonished your LSL for not immediately filing criminal charges against Thejane. He also rightly accused you of catering to the public interest and protecting your members instead of taking serious criminal action against him? Your suggestion that a criminal case will be filed after the civil action is disingenuous. If the LSL had been effective and serious in reining in its crooks, Thejane would be in jail now, as he has been denied bail.

Ntate Tuke, let us face the hard facts. Chief Justice Sakoane spoke for many Basotho who were frustrated by the long-standing inaction of the LSL against its many criminal members. Remember, Chief Justice Sakoane was not alone in speaking out against erring lawyers. Justice Tseliso Monapathi publicly admonished your members who were working furtively under trees and in the trunks of third and fourth-hand cars imported from the garbage dumps of Tokyo and Hiroshima.

Of course, LSL has some respectable, well-respected lawyers. But as you know very well, it is also made up of the ubiquitous crooks, thieves, scumbags, fools, frauds, cheats, swindlers and outright shabby gangs. This explains why many Basotho (those who can afford it) travel thousands of miles to South Africa to seek better legal advice. You may be surprised to know that such crooks and thieves even exist in your Governing Council or Executive Committee (whatever you call it) which oversees LSL. One of them had the audacity to put us (lesotho times) Some dishonest and vexatious litigation, in which the judge ordered your sleazy councillor to reimburse us for our legal fees out of his own pocket. Needless to say, he did not do so. We are not surprised by this, as LSL harbours abominable “lawyers” who have a complete disregard for their clients and have little or no knowledge of the law. For example, how do you describe a lawyer going to court and wasting the judge’s valuable time asking them to shut down Scrutator and delist the publication altogether because – in that lawyer’s twisted mind – the newspaper is not “registered”? How do you describe such bullshit legal advice?

To your credit, Ntate Tuke, you are at least trying to reform LSL. The previous leaders of the group were either comatose or criminals. So your attempts to rein in corrupt lawyers are refreshing. But must your efforts not only be put into action, but also seen to be trying? So far, you have been talking, talking, talking, talking, talking, talking, talking, and more talking, Ntate Tuke.

Thejane should have fallen from the sky like a godsend. He should have been your role model in dealing with the growing number of cheaters in the LSL ranks. But he is still enjoying his loot. Your reasons for not dealing with him criminally cannot convince Ntate Tuke.

This also explains why CJ Sakoane is right to be angry with you. One reason why Scrutator fell deeply in love with CJ Sakoane is that he can be abrasive if the situation calls for it. He is not afraid to take off the gloves. He can be a judicial tyrant if the situation calls for it. He speaks his mind. As a strong woman who speaks her mind, I admire all these qualities in a judge. Ntate Sakoane is securing the reputation and critical role of the judiciary as one of the most important sectors of the country. But he has been let down by organizations such as LSL.

CJ Sakoane’s motive was certainly not “hatred for LSL” as Ntate Tuke claimed. He was simply speaking on behalf of all Basotho people to denounce the LSL scammers.

Instead, LSL’s chances of recovering ‘M’e Setala’s money would be improved if you quickly filed a criminal complaint against Thejane. The case against Thejane is open and closed. The facts are clear. A crooked lawyer stealing the proceeds of a poor woman’s successful insurance claim?

Why do you think this case took five years in the criminal courts as you say? It is true that legal procedures in Lesotho are long. But are some of these lengthy procedures legal skulduggery, over-institutionalised by dodgy lawyers? The longer a case drags on, the more fees they charge. If a case is as clear as the M’e Setala case, it should be dealt with quickly and closed, the criminal case locked up and the key thrown into the deep end of the Katse Dam.

Chief Justice Sarkoan would be delighted if the criminal case landed on his desk. In fact, as a legal “expert,” Skrutto believes that the chances of recovering “M’e Setala’s” money are greater in a criminal trial.

I have no doubt that CJ Sakoane will tell Setala: “I sentenced you to 15 years in prison because you stole money from a poor woman. Unless you pay her back within 72 hours, I will add another 20 years.”

Faced with the prospect of spending 35 years in prison, I bet Thejane would ask anyoneprostitute–With whomever she hid the stolen goods—recover it immediately and pay it to ‘M’e Setala. If he had spent all the money, he would have found it, probably from a lawyer-swindler.

yesOur civil process – necessary as it may seem – amounts to tinkering around the edges with Ntate Tuke. It is not too late for your LSL to heed CJ Sakoane’s call and take stern action against Thejane. You cannot say there is nothing else you can do to help ‘M’e Setala. You have much to do.

Please initiate criminal proceedings against him and engage the Director of Public Prosecutions (DPP) to expedite the case through the Registrar of the High Court. I have no doubt that CJ Sakoane will quickly assign the case to another judge or handle it personally. I hope he handles it personally. In the meantime, can LSL remove Thejane from the roll of lawyers and ensure that he is banned from practice for life. You must also check if he is dual practicing in South Africa and elsewhere and disbar him there as well. Please don’t tell us Ntate Tuke that there are some sacred and complicated legal procedures you need to follow before LSL takes drastic action against Thejane. A thief is a thief and must be treated like a thief.

You slurred your words, Ntate Tuke, as you berated CJ Sakoane. You hinted that LSL was doing something behind the scenes. That is not what is needed here. What we want is real action, which LSL must expose in a press conference. Ntate Tuke, please stop pandering to the crowd. Show us the real action mentioned above. CJ Sakoane is right to smell a conspiracy. You seem to want a civil judgment to cover up your inaction in the criminal prosecution to protect your members, as CJ Sakoane rightly pointed out. CJ Sakoane is right to refuse to be part of this scam. I will be watching this case closely until Thejane is locked up and his cell key is dropped by Katse. This is a test for you Ntate Tuke. Do not waste this opportunity to prove that you are serious about saving Basotho from the clutches of the crooks and scumbags who are entrenched in LSL.

I have often seen you drinking with different women at various nightclubs in Gauteng and KwaZulu-Natal. The other day you followed me to the toilets at Maslow in Sandton and tried to get a lift from me. I almost had an affair after seeing the drinks you bought for another girl. Anyway, I am not a mean person. I did not mind your shameless behavior because I thought you were spending your own money. I did not realize that you are a predator without conscience. You have been enjoying the money you stole from a poor woman who trusted you. Anyway, you have stolen nearly RM100,000 from her for “legal services”. I don’t know what to say to describe you. In order to come up with a suitable nickname, I had to hold a competition and invite people to use carefully selected words to describe you.

Now, all I can say is that you are a disgrace to the legal profession and anyone who calls himself a lawyer. You are not only a scumbag, you are a vile scumbag. You are a pig. I apologize to pigs because they are kind animals that humans get delicious barbecue ribs from. You are a dog. But I also apologize to man’s best friend. You are a liar, a cheat, a fool.
