The police started a pre-trial investigation after receiving a statement from the passenger, in which the man said that his “Bolt” driver, who worked in Kaunas, was beaten when he was taking him home at night.

“During the journey, the driver started to scold me for driving, and after stopping the car, he forcibly pulled me out of the car and deliberately hit me on the head and face several times. After that, I fell to the ground and the driver got into the car and drove away,” the victim said in the statement.

Later in the trial, he said he had visited a friend that evening to celebrate his birthday and then decided to go home. Indeed, it was not a taxi – his wife, who had not attended the party, was supposed to bring him back, but it was late and the woman decided it would be best to call a Bolt driver to pick him up.

The woman who ordered the transport service immediately noticed that her husband was supposed to be picked up by a woman – she watched the car leave her friend’s house, but after driving just one kilometer, the car suddenly stopped and did not leave for a long time. When suspicions arose, she contacted the wife of her husband’s friend, who assured her that her husband did leave, but the car was not driven by a woman, but by a man.

“I tracked the man’s route through the app, because he had neither a phone nor keys, and when the car had been parked for a long time, I called the driver and asked him to ‘send the man back’ from where he had taken him,” the woman said. – Then I called my friend’s wife and asked if she could go and see, because Bolt’s car had been parked in one place for a long time. She drove away – the man was covered in bruises, bruises, and his face was red and blue…”

The news should have shocked the woman, and she got in the car to pick him up. But when she saw his appearance, she decided to go to the Kaunas clinic immediately. While being examined by medical staff, she called the driver of “Bolt” several times, but he did not talk: “I told him that my husband was beaten and we are in the clinic now. I don’t remember what the driver answered, but he didn’t answer anything special. I made the situation public. Operators That’s how I found out who the driver was in the app, and there was no response from Bolt itself at all.”

“After calming down, the man told me that he was driving with Bolt and there was a conflict. The driver told me not to vomit in the car, and then he hit me in the abdomen,” the woman said. After the incident, her husband was unemployed for about three weeks.

At the time, her husband never came home, saying he got in a Bolt delivery van after his birthday.

“When I got in the Bolt, it started traveldidn’t talk to the driver, he just told me not to throw up, then the car stopped and the driver got out, so I got out too,” he said. – When the driver came back to the car, I got in too, and I told them to take me home because I didn’t know where we were. But the driver got out again, and when he came to me, he started pulling on my hood, then he dragged me outside the car and hit me in the face, on the right cheekbone, he really hit me three times. Several times, and I fell to the ground.”

The man said that he lost consciousness for a while, and when he came to his senses, he saw that the car had gone about 100 meters.

“One shoe was left in the car, which I did not wear because I had blisters on my feet, and my handbag was also left in the car, which was later taken away by the driver,” he said.

At the time, the driver categorically denied abusing his passengers.

The accused driver said: “When the victim got in the car, I greeted him as usual but he did not answer any questions and smelled of alcohol and then he started screaming loudly. “- He then told me “you will clean it up”- I stopped to let the victim out and I said I would not take him anymore. He started screaming at me but when he saw I would not give in to him he apologized and asked to take me home but I had already decided not to take him.”

The driver made no secret of the fact that passengers were often trapped in the car while on duty, but some of them escaped while others paid for dry cleaning.

The man being charged explained: “This has happened many times, so I have learned my lesson and will not transport people like this.”

According to him, the passenger who was supposed to get off the bus did not get off and got on again: “Then I started screaming and said I would not take him away and I told him to get off the bus.”

The driver also categorically denied abusing passengers, but admitted that he left a handbag in the cabin, threw it out of the window, and told his wife about it over the phone.

The conversation in the cab was recorded, so the police obtained those recordings and added them to the criminal case. The recordings showed that there was indeed a conflict between the driver and the passenger, during which the passenger was injured.

“After reviewing the evidence in the criminal case, the court concludes that the allegations are proven – the defendant, as the driver of the Bolt, intentionally grabbed the passenger’s jacket during a verbal dispute and, after pulling him out of the Toyota Prius, punched the passenger in at least three areas of the head, causing subcutaneous hemorrhages on the left eyelid, right cheek, left temple and forehead after the victim fell face down on the ground due to the punches. He also suffered skin abrasions and subcutaneous hemorrhages on the calf, right cheek, left cheek, temple, and lower eyelid of the left eye, and skin abrasions on the left knee and left thigh, causing minor health problems,” the court said.

The court said that based on the driver’s age, education and life experience, he understood that a particular type of physical violence (a dangerous act) would likely result in appropriate consequences for the victim (in this case, minor injuries).

“The purpose of criminal punishment is not only to punish a person who has committed a crime, deprive him of and limit the possibility of committing new crimes, but also to influence him so that after serving his sentence he will obey the law and not commit crimes again. The court, after evaluating the defendant’s behavior, specific circumstances, medical information provided, considers that in this case, the purpose of punishment will be achieved by imposing on the defendant the type of punishment provided for in this sanction – restriction of freedom, the duration of which is determined after evaluating the criminal behavior and the defendant’s characteristic data, without providing strict supervision to the defendant, by imposing the obligation of mutual coordination”, – court It was decided to restrict the driver’s freedom for one year.

While serving his sentence, if it is not work-related, he must perform such work at home between 11pm and 6am or register with employment services and attend a behaviour modification programme.

In addition, the victim was awarded €1,000 in non-pecuniary damages from the driver, although the damage he suffered was estimated to be four times greater.

“The court took into account that, as a result of the use of violence, the victim did not receive hospital treatment, but only outpatient treatment, so it can be assumed that he did not experience any significant inconvenience and had no sequelae. “Affect”, – the judgment also noted that the victim was in a state of intoxication at the time of the incident, he did not provide data indicating that the incident caused him to suffer a huge mental blow or that his reputation and communication skills deteriorated significantly as a result.
