Attorney General appeals Judge Gino Persaud’s ruling upholding PDVSA arbitration award

Guyana’s Attorney General Anil Nandlall yesterday filed an appeal with the Full Court against a ruling by Justice Gino Persaud in favour of two companies seeking to enforce an arbitration award against Venezuelan oil company PDVSA, asking for the entire judgment to be set aside as it could affect Guyana’s national security and national sovereignty.

In his appeal, the attorney general also asked for an order that the defendants (who he listed include ConocoPhillips, Venezuela Ltd. and ConocoPhillips, Petroleos de Venezuela SA, Corpoguanipa and Petroleo de Venezuela SA) pay the costs of the collegial panel and the lower court.

Judge Persaud’s ruling stems from an application by Phillips Petroleum Venezuela Ltd. and ConocoPhillips to enforce a 2019 arbitration award against PDVSA, Corpoguanipa and PDVSA Petroleo. Similar applications have been made and granted in other Caribbean jurisdictions. PDVSA has been engaged in commercial transactions with the Guyana government for many years but still has outstanding payments.
