The Mombasa High Court on Thursday blocked the government’s decision to increase the Road Maintenance Fee Fund (RMLF) by Ksh70.7.
The petitioner, George Odhiambo Juma, challenged the price hike in court, claiming that the government failed to adequately engage the public
The court ordered that the salary increase be suspended until the case is heard and resolved.
The ruling states that “Pending the hearing of the Notice of Motion dated August 2, 2024, a Preservation Order is hereby issued restraining the Defendants, jointly or severally, whether by themselves, their officers, agents, employees or other persons or entities acting under the direction of the Defendants, from implementing and enforcing the Road Maintenance Fee Levy Fund (Levy) Order 2024.”
The decision came after a public outcry against the increase in taxes from Ksh18 to Ksh25 per litre.
The Indian government had implemented this policy of increasing funds in July, and the Energy and Petroleum Regulatory Authority (EPRA) announced the change on July 14, 2024 to increase the road maintenance fund.
Motorists pay a tax at the gas station for every litre of petrol or kerosene they buy.
