The brother of a Kenyan protester who was killed during anti-government demonstrations is suing the police, according to his lawyer.
Police shot and killed David Chege outside Parliament House on June 25, the bloodiest day in weeks of rallies in Kenya against the government of President William Ruto.
Those demonstrations have left at least 60 people dead since mid-June, according to groups including the government-funded Kenya National Commission on Human Rights (KNCHR) and Amnesty Kenya.
Ochiel Dudley, a lawyer representing Chege’s brother Brian Kinyanjui, confirmed that the lawsuit will be heard in the Nairobi High Court on October 16. The lawsuit challenges the unlawful killing of Chege and criticizes the delay in the investigation, arguing that the police violated Chege’s right to life and failed to arrest or prosecute those responsible.
The lawsuit, which is being led by Kinyanjui and the Independent Forensic Team, names senior police officials, the police watchdog and the prosecution as defendants.
In an affidavit, Kinyangjui said there was “no reason for the police to kill my brother,” stressing that Cheger, a freelance IT expert, was “peaceful and unarmed.”
The petition calls for the prosecution of the police officer suspected of killing Cheger and for authorities to end their investigation. It also asks the attorney general to issue a public apology and pay unspecified damages.
