08-27-24.- The Communist Party of Venezuela (PCV) considers that the ruling issued by the Electoral Commission of the Supreme Court (TSJ), which validates the results of the presidential elections announced by the National Electoral Council (CNE) of the July 28 elections, once again proves the existence of a conspiracy brewing at the top of political and economic power against the Constitution and the sovereignty of the people expressed in the vote, as provided for in Article 5 of the Magna Carta:

“Sovereignty belongs inalienably to the people, who exercise it directly in the manner prescribed by this Constitution and the laws, and indirectly through the electoral system through the organs exercising public power. State organs derive from and are subordinate to popular sovereignty.

We are witnessing a conspiracy of public power (openly controlled by the Government-PSUV leadership), through pseudo-legal procedures, that has colluded to prevent the public from obtaining information about the results and the Government that are printed in the record box where each voter’s actual ballot is protected.

The TSJ Electoral College not only usurped the constitutional powers of the CNE, but also conducted an “expert process” with so-called national and international experts whose identities were not disclosed; this issue hindered the public’s attestation of their professionalism and technical skills and increased distrust in state institutions.

The Electoral Chamber’s ruling was predictable. The actions of the TSJ are well known and demonstrate its absolute subservience to the executive branch, being part of an illegal process of criminalization and judicialization of the struggles of working class, trade union, political and social activists; and the intervention of the leadership of political parties, handing them over to mercenaries at the service of the government PSUV. However, this new ruling overcomes other previous judicial anomie, since, far from offering a solution to the serious political crisis that the country is going through, it exacerbates uncertainty and increases legitimate doubts about the results of the electoral process, which cannot be reviewed by checking with the records published by the electoral bodies and held by the political organizations involved.

This is what the leadership in power fears: once the CNE publishes the results table by table, they can be compared with the censored records in the hands of tens of thousands of Venezuelan men and women who participated in the investigation and witnesses from political parties; if there are inconsistencies, the results can be challenged in accordance with the constitution and the law, thus forcing a real trial.

In order to avoid this process; to seize the vote counting records held by the parties and their witnesses; to prevent them from being subsequently used as evidence and to verify the untrustworthy results given by the President of the CNE, this impersonation was organized before the Electoral Chamber and, if not corrected by the TSJ Constitutional Court, could open the door to an era of greater social and political instability in Venezuela.

With this statement from the Electoral College, it became clear to the entire nation that the CNE had not performed its functions as provided for in Article 293 of the Constitution by not publishing the tabulated results and by suspending subsequent audits, such as the second phase of the telecommunications audit, the second phase of the citizen verification and the second phase of the electoral data; essential for the transparency of the verification process and even to determine whether there had been an alleged “hacking attack”. Therefore, we demand from the Central Committee that the Ministry of Public Affairs conduct the relevant investigations to determine the responsibility of the electoral institutions and the personal responsibility of the principal and alternate principals of the Central Electoral Commission.

In light of this series of irregularities covering a controversial electoral process, the PCV is evaluating whether to file an appeal with the TSJ Constitutional Chamber for protection against violations of collective and decentralized interests; and to accompany other legal and political actions, such as those proposed by the Popular Democratic Front (FDP) (of which we are part) and our former presidential candidate Enrique Márquez, to guarantee respect for popular sovereignty and restore the rule of law.

We condemn the use of the TSJ Electoral College ruling as an excuse to expand the repression of our people; persecution and dismissals in the workplace; criminalization and judicialization of popular movements and political and social organizations and their activists. Moreover, the invocation of this ruling (illegally and unconstitutionally) by senior leaders of the PSUV government, such as Jorge Rodríguez or Diosdado Cabello, to limit the participation of political actors in the upcoming electoral process is reprehensible from every perspective.

We oppose human rights violations and demand that the Nicolás Maduro government release hundreds of protesters (mostly from the popular class) who have been detained and subjected to procedures that violate due process and are accused of “terrorism” without any basis.

We once again ask the PCV to publish the classified results – and not just the general results as the TSJ Electoral Chamber stipulates – and allow citizens to audit each ballot box and count the votes. Only in this way can the people’s doubts be eliminated and the will expressed through voting be upheld.

The PCV reiterates its firm rejection of extra-constitutional scenarios. The solution to the current crisis must be achieved under the leadership of the Venezuelan people, especially the working class, without any foreign interference.

As the vanguard, the communist fighting forces will continue to stand firm, unite, organize struggles, and defend the full validity of the Constitution and the sovereignty of the people.
