08-26-24.-The Supreme Court (TSJ) dismissed the challenge filed by former presidential candidate Enrique Márquez to the election of Speaker of the National Assembly Calicelia Rodríguez as untimely.
“On August 20, the application filed by citizen Enrique Márquez as former presidential candidate of the Bolivarian Republic of Venezuela and nominated by the Centados en la Gente political party to participate in the electoral process was declared inadmissible because it occurred on July 28, 2024. This is how it was decided,” said the ruling number AVP-001 of file 2024-000034.
What is avoidance?
This is the act of asking a judge or court member or prosecutor not to interfere with the judicial process because they are not impartial. The interested party must make the challenge in formal writing and state the reasons for their request.
In this sense, Márquez went to the TSJ on Tuesday, August 20, to challenge Callislia Rodríguez, because he believed that her political preferences (PSUV) affected the integrity of the case for the alleged legitimacy of Nicolás Maduro’s victory in the presidential elections.
Márquez believes that the Electoral Chamber did not show “appropriateness” in exercising its right to develop the presidential election cause around the events of July 28.
Marquez told the media that Rodriguez “has political ties to the United Socialist Party of Venezuela (PSUV), he even served as a councillor, and was active until recently. In this way, I think there is enough evidence that the president of the court cannot participate in this case.”
After hearing the recusation ruling, Perkins Rocha, legal counsel for Venezuela’s Vent party, called the decision “unacceptable and unusual.”
Rocha believes that one cannot trust the impartiality of the TSJ: “So: how can we trust a judiciary whose president openly supports the partisan struggle of the appellants with whom she agrees; and who, moreover, lie about the trial date of their conduct?” he concluded.
