Special Counsel Jack Smith has filed a new indictment against Donald Trump. It concerns the former president’s attempts to remain in power after losing the election. The new, streamlined indictment takes into account the Supreme Court’s July 1 ruling granting Trump partial immunity.

In the new indictment approved by the new grand jury, investigators still charged Trump with the same charges related to overturning the election results and remaining in power. However, they limited it to Trump’s private activities.

Missing from the original indictment were items like: a reference to the then-president pressuring the Justice Department to support Trump’s claims of a “stolen” election despite a lack of evidence. In a precedent-setting decision in early July, the Supreme Court ruled that the president’s official actions — those related to his fundamental duties as head of state — are protected by “absolute” immunity. That also includes the president’s contacts with members of his administration, the court found.

The new indictment is nine pages shorter

In the new indictment, which is nine pages shorter than the original, investigators focus on activities conducted by Trump and his associates in their private capacities.

The new indictment was filed 70 days before the election, 10 days before the deadline, and excludes the possibility of charging political candidates. Still, it is unlikely that the process will start before the presidential election in November.

Trump himself reacted to the prosecutor’s actions in a rather unusual way on his social networking site TRUTH Social – by retweeting a post suggesting that if he wins the election, he will fire the prosecutor and drop the charges against himself.
