Despite the Ministry of Internal Trade and Consumer Protection’s warning to all companies and shops in Damascus, the situation in which sales outlets in Damascus’ commercial markets do not return sold goods regardless of their condition is considered a blatant violation of consumer rights. Two days later, she bought a different size or dress, but the seller refused to return the dress, saying that the dress had been sold at that price and could not be returned or exchanged. Knowing that there was no sign indicating that the goods could not be exchanged or returned, she was forced to contact the “Consumer Protection” and complain to the store to request a replacement.
Non-refundable and non-exchangeable
Dr. Abdul Razzaq Al-Sheikh, a professor at a private university, pointed out that the law is clear and the Ministry of Domestic Trade and Consumer Protection warned shops and shopping malls not to write the words “goods sold are not returnable or exchangeable” or any other similar phrases on sales invoices or inside stores, or any publications targeting consumers that are inconsistent with the statutory rights of consumers to return defective or adulterated goods, violate the rights of consumers, and to remove these phrases from all commercial shops and sales outlets.
He explained that the existence of illegal activities in the market showed that the penalties in the early stage were weak, which led to businesses taking advantage of the matter passively and damaging the rights and interests of consumers.

Consumers have the right to return products
Mohammed Maher Beida, the director of consumer protection in Damascus, stated that “Decree No. 8, according to its article 4, regulates the cases of return or exchange, which refers to the right of consumers to replace materials, products or goods once for the same type or the same value, without incurring any costs, within 3 days of receipt”, and that the seller is obliged to replace and return the goods within a week of purchase if they are found to be defective or faulty. It cannot be replaced with another of the same type or the same value.

He points out that the consumer has no right to exchange goods if the nature of the material, product or good, its characteristics or the method of packaging prevents its exchange or return, or if it is impossible to exchange or return the goods. Bayda called on citizens to promote a culture of complaints if they feel they are being treated unfairly and to proactively call the complaint hotline 119, which is designated by the ministry and operates 24 hours a day, and to obtain invoices proving that they obtained the materials, products, goods or services, including the type, transaction date and price paid.
He noted that the Ministry of Domestic Trade and Consumer Protection had issued a decision warning sellers not to place the words “goods sold are not returnable or exchangeable”.
He added: In the case of refusal to return or exchange goods, the complaint is handled by organizing a judicial investigation in accordance with the law, or by making an exchange or return and the complainant giving up the complaint.
