According to the ruling of the Tbilisi City Court, the decree of the President of Georgia of July 15, 2024 on the appointment of Kakha Tsikalishvili as a member of the Supreme Judicial Council was suspended.
Tbilisi City Court issued a statement:
On July 22, 2024, the Administrative Affairs Committee of the Tbilisi City Court accepted the lawsuit of M. K., defendant – against the President of Georgia.
The plaintiff requested to become a member of the Supreme Judicial Council of Georgia. To repeal the Decree of the President of Georgia on appointments and promulgation of new legal acts dated July 15, 2024, in particular, ordering the President of Georgia to appoint the plaintiff as a member of the Supreme Judicial Council of Georgia.
In the same lawsuit, the plaintiffs seek to secure the stay of the proceedings of the Decree of the President of Georgia of July 15, 2024 until the end of the proceedings, as well as a prohibition on holding new elections for the President of Georgia and on the appointment of another new member of the Supreme Judicial Council of Georgia (in any form) (except the plaintiffs) until the end of the proceedings.
By the decision of the Administrative Affairs Committee of the Tbilisi City Court dated July 22, 2024, the motion of M. K. for compensation was granted. According to the court decision, the validity of the Decree of the President of Georgia dated July 15, 2024 is suspended until the end of the proceedings. In addition, the President of Georgia is prohibited from holding a new competition and appointing another new member of the Supreme Judicial Council of Georgia (in any form) until the final completion of the proceedings in this case.
