“The body in the closet” – Congolese independence team

The Institute for Human Rights Research (IRDH) is following with interest the statements by the Minister of Justice, His Excellency Constant Mutamba Tunguga, in the Democratic Republic of the Congo (DRC) aimed at “bringing justice to the table”. The latest revelations concern the instructions he received from the Head of State to “exhume the bodies from the sanctum of justice”.

In fact, in addition to his intention to reform the judicial system, the Minister also spoke about major legal cases, especially those related to: (i) the new referral of serious crimes to the International Criminal Court (ICC); (ii) the IGF report on corruption over the past three years; (iii) the fight against embezzlement and money laundering; (iv) the legal closure of churches and non-profit organizations; and (v) the decongestion of the Republic’s prison centers.

IRDH puts the minister to the test. He is ready to assist in investigating allegations of misappropriation of public funds and corruption in the province of Haut-Katanga. The counter-argument is that, on the one hand, these numerous media releases amount to nothing more than simple wishful thinking. On the other hand, the Congolese litigants are being treated as a joke.

misappropriation of final accounts and pensions by the CNSS, Gécamines, SNCC, Sodimico and Sogetel companies;
misappropriation of mining rights paid by SOMIKA and CDM for the construction of the Kipopo – Poleni road (Tshamalale district, Lubumbashi Annex commune);
Corruption at Lubumbashi City Hall over CRAA dumpsite relocation, Annex Commune, Kasapa District;
CHEMAF and RUASHI Mining companies in Ruashi Commune exacerbated corruption in the pollution case.

IRDH recalls that these condemnations and the bodies in the cupboards in Haut-Katanga province date back several years.

Of the more than 3,000 victims of pensioners and listed companies, more than 2,000 have died without ever having their rights restored;
Funding for the construction of the Kipopo-Poleni road has been fully disbursed since September 2019, but the project has been abandoned;
The communal garbage dump at the CRAA cells in Kasapa district caused skin diseases, but Lubumbashi City Hall ignored it;
Various lung diseases caused by pollution from CHEMAF and RUASHI mining companies were trivialized and harmed the population of Ruashi commune.
