According to the indictment filed in court, the accused was charged with murder contrary to Section 187 of Volume 3, Chapter 10:01 of the Laws of The Gambia.
The prosecution alleged that on or about June 22, 2024, the accused, Bakary Jawo, “intentionally and knowingly caused the death” of 26-year-old Aja Majula Hydra at Dunas nightclub in Palmarima, Kanifing City, by putting drugs in her water bottle, which she then drank.
Police prosecutor Sub-Inspector Kebbeh, appearing for the Inspector General of Police, told the court, “The offence the accused is charged with is a capital offence.” He applied for transfer of the case to the Special Crimes Branch of the High Court and remand to Mile 2 Central Jail under Section 3 Legal Notice, Section 62 and Section 208A of the Criminal Procedure Code.
In her ruling, Magistrate Sarah Mbai granted the prosecutor’s application, saying her court “lacked jurisdiction to hear the case” and ordered the accused to be remanded in custody under Section 208A of the Criminal Procedure Code.
