Tegucigalpa – From Wednesday, August 14, to Friday, August 16, the trial will focus on the deprivation of ownership of seven bank accounts whose legal owner was Ebal Jair Díaz Lupian, former Secretary of State in the Presidency, who assisted the Public Ministry through the Special Prosecutor’s Office against Organized Crime (FESCCO).
The congressman detailed in a communication that the debate will be conducted by prosecutors from the FESCCO Anti-Money Laundering and Property Deprivation Unit (SCDLAPD), who will present documents and expert evidence to support their claims. The congressman asks for a ruling in favor of the State of Honduras for the final confiscation of assets.
It should be added that the approach to be taken in the trial is based on the Law on the Deprivation of Assets of Illegal Origin, in particular article 11 and its reasons 1, 2 and 8, which indicate that the deprivation action will be determined in the field when there is no reason or legal-economic reason to prove its origin, when there is no legitimate reason to increase the assets, and when the interested party or affected party cannot justify its legal origin.
In this sense, the request would concern the provisions of article 65, paragraph 5, of the Law on the Explicit Deprivation of Assets of Illegal Origin: “the confiscation of all real, primary or accessory rights, divisions, liens or any other restrictions on the availability or use of the property and its distribution to the State of Honduras through an OABI order, ordering it to distribute it according to law.”
The Public Ministry intends to permanently deprive seven bank accounts of ownership, which at the time processed an amount of approximately more than 51 million lempiras (L. 51,500.554.55).
It is worth remembering that on July 30, the Attorney General himself, lawyer Johel Zelaya Álvarez, filed a tax claim against Díaz Lumpian and 14 other people, accusing them of a massive fraud in the development of a housing project for more than 10,000 Honduran families, which was masterminded by former senior officials of the previous government.pound
