Santiago (Dominican Republic) – The Santiago Prosecutor’s Office has gathered sufficient evidence and sentenced to 20 years in prison a man who sexually raped a woman, attacked her with a knife in her home and, after abusing and threatening her with the intent to kill her, stole some of her belongings during an incident that occurred in 2019.

The facts presented by the San Diego Prosecutor’s Office in the case against Leyson Montero (Alex El Guardia) indicate that the repeat offender intercepted the victim at her home on the morning of March 26, 2019, while she was carrying her 6 items. He held her 3-year-old son in his arms, forced her into the house, gagged her, and threatened to kill her if she screamed.

The man maintained a violent and threatening attitude, snatched the child from the victim’s arms, and placed a knife to the baby’s neck, forcing her to obey and strip naked in order to commit a sexual crime against the victim.

The abuser also stole a cell phone and P2,500 in cash from the victim.

Public Ministry Trial Prosecutor Yeny Liranzo used a variety of expert evidence, documentary evidence and physical evidence collected by the Investigative Team of the Unit for Integrated Care of Victims of Gender, Domestic Violence and Sexual Crimes of the Public Prosecutor’s Office to explain in detail to the judges of the Second Panel that Montero is a serial rapist with a history of abusing people in the same modus operandi.

He was arrested on December 15, 2020, pursuant to Court Order No. 10255-2020.

The Santiago Prosecutor’s Office, which has concealed the identity of the victim to avoid overexposure and invasion of her privacy, filed charges against the defendants for violations of articles 309-1, 309-3, texts A, C, D, E and F; and articles 331, 379 and 382 of the Dominican Penal Code, as amended by Law No. 24-97, on gender violence, which classifies and punishes crimes such as aggravated violence against women, sexual rape and aggravated robbery.

The investigation, prosecution and sentencing process took place while the defendant was in prison for another sentence in 2022.

In 2022, the investigative body sentenced Montero again to 20 years in prison for sexual rape and aggravated robbery to the detriment of another woman in the El Ingenio Arriba district, in the municipality of Santiago Sisters.

The prosecutor’s office subdued Montero and charged him with aggravated gender-based violence, rape and robbery with aggression.

The penalty was imposed by the jurisdiction’s Fourth Collegiate Court, which also ordered Montero to pay P200,000 in cash compensation.
