Rick asks KPU Constitutional Court’s decision to take effect immediately without amending the law: National Okezone

Jakarta – Rieke Diah Pitaloka, a member of the PDI-P faction of the Indonesian House of Representatives, reminded the General Election Commission (KPU) that the decision of the Constitutional Court (MK) is effective immediately without the need to amend the law (self-executing).

“Therefore, the KPU is obliged by law to immediately amend Articles 11 and 15 of KPU Regulation (PKPU) No. 8/2024 regarding the nomination of the Governor and Deputy Governor, Regent and Deputy Regent, Mayor and Deputy Mayor,” he said in a press statement, Saturday (August 24, 2024).

To this end, Rieke stressed that the amendment of Articles 11 and 15 of PKPU No. 8/2024 is mandatory, based on the considerations and rulings of the Constitutional Court judgment (20/08/2024).

First, he continued, MK Decision No. 70/PUU-XXII/2024 on the age limit for candidates for regional chairpersons in Article 7, Paragraph (2), Item e of the Regional Election Law: “Indonesian citizens who can become candidates for governor, regent, and mayor are those who meet the “minimum age requirement of 30 years for candidates for governor, and 25 years for candidates for regent and mayor.”

He continued that Article 15 of PKPU No. 8/2024 uses the legal basis of Supreme Court Decision No. 23/P/HUM/2024: “The age limit for candidates for regional leaders is calculated from the time when the elected candidate assumes office”.

“Thus, what is stipulated is not the age requirement for nomination, but the conditions for the appointment of the selected candidate,” he stressed.
