Tahiti, June 11, 2024 – This Tuesday, a man was sentenced by the Criminal Court to five years in prison for sexually assaulting his young neighbor twice while he was sleeping on the same night. For gay victims, the trauma is even more severe.
The man who appeared in court on Tuesday for sexually assaulting his young neighbor and his victim knew each other well. He was a longtime friend of the family and lived just a stone’s throw away from the young woman’s home. He even had a relationship with her sister for several years. The situation was never enough for him: “When he was with my sister, he said he needed two women.” The victim explained. The man continued to visit his family since they separated in 2015, especially his sister, who he said he had fallen in love with. A love that was affirmed but not reciprocated: “He often came for a beer and once the alcohol reached a certain level he would make comments to me. As soon as the event started I immediately ended the night and asked him to leave.” the young woman said. And until this sad night of May 29, 2021, the defendant had respected that.
Indeed, although the young woman was not in the habit of drinking excessively on weekdays, that night she decided to give it a go and even invited the “neighbor” to the party. The latter misinterpreted the signal, thinking that the wind had finally turned in his favor. Taking advantage of the fact that several guests had already fallen asleep, the man waited until the young woman had gone to bed before inviting himself to her bed. The latter, who was drunk and fell asleep, did not immediately react to the inappropriate gestures of the attacker, thinking that it was her partner. However, due to the unusual lack of lights in the house, the victim realized the situation and managed to stand up and scare off the unwelcome person. But the young woman, too drunk to settle the score or ask for help, went back to bed. A slip. Frustrated by the failure to satisfy his desires, the attacker became more persistent later that night and did not hesitate to remove the victim’s shorts and try to penetrate her.
“I was too drunk. I couldn’t penetrate her with my penis,” The defendant said. “So, I put my fingers in. But I never succeeded in penetrating her with my penis.” For her part, the victim claimed to have felt the comings and goings and therefore to have been raped. In any case, the court mainly reserved the expert report of the psychologist on the victim, confirming that the victim suffered from severe consternation, psychological paralysis, sleep disorders and epileptic seizures, typical characteristics of obvious trauma. The defendant was sentenced to 5 years’ imprisonment, of which two years were suspended, and was required to pay compensation of 3 million francs to the victim.
