Aziz Abu Naim claimed that he was not given the right to express his views before the Kelantan state assembly speaker resigned from his seat.
(New Standard Time) – The High Court will hear a plea by ousted Nenggeri MP Azizi Abu Naim to stop a by-election to fill the seat he was forced to vacate.
Judicial Commissioner Roz Mawar Rozain will hear the injunction application on Thursday afternoon.
FMT understands the Electoral Commission (EC) intends to oppose the application.
Last week, the electoral body was scheduled to meet this Friday to discuss preparations for the by-election.
Aziz filed the lawsuit earlier this week challenging his sacking from Bersatu and the vacancy of the Nyingchi state seat.
Bersatu said his membership had been revoked as Aziz failed to pledge allegiance to the party and continued to support the government of Prime Minister Anwar Ibrahim.
Aziz, who is also the Gua Musang MP, was one of the six Bersatu MPs who pledged their support to Anwar.
The others are Syed Abu Hussin Hafiz Syed Abdul Fasal (Bukit Gantang), Dr Zulkafperi Hanapi (Tanjong Karang), Zahari Kechik (Jeri), Iskandar Dzulkarnain Abdul Khalid (Kuala Kangsar) and Suhaili Abdul Rahman (Labuan).
In his lawsuit, Aziz claimed that the amendment to Article 10 of Bersatu’s constitution, which states that a person’s party membership will be terminated if they support a political opponent, was unconstitutional.
He wants the court to strike down the amendments as violating the federal constitution.
Aziz also wants the court to declare the vacancy notice issued by the Kelantan state assembly to the Election Commission invalid. He said he was not given the right to defend himself before the seat became vacant.
He named Bersatu president Muhyiddin Yassin, secretary-general Hamzah Zainudin, Kelantan state assembly speaker Amar Abdullah and the Election Commission as defendants.
