The Legislative Assembly approved a series of reforms to the Special Law on Regularization of Housing Land by 57 votes in favor. The changes are intended to provide legal protection for owners of plots of land developed and sold before September 7, 2012.
The reform provides that all residential use subdivisions developed and sold before this date can be regularised, provided their commercialisation is demonstrated by reliable documentation.
In addition, one of the changes is to extend the deadline for declaring a division to 24 months after the law comes into force. Likewise, the maximum period for the regularization process is two years, and if the process is not completed within the stipulated time, sanctions will be imposed.
The Ministry of Housing, as the governing body, now has the power to request regularization of previously undeclared subdivisions on an ex officio basis. Documentary requirements have also been modified, eliminating the need for a cadastral study by the National Registration Centre and replacing it with a certified copy of a certificate issued by the Ministry of Housing.
The reforms, which will enter into force eight days after their publication in the Official Gazette, mark progress in the regularization of property and will benefit thousands of Salvadoran families.
