Jacana, Victoria: A teenager accused of raping a woman has been refused bail because he poses a risk to the community

A teenage boy allegedly sexually assaulted a woman while she was jogging after he skipped classes, a court heard.

The 16-year-old, who cannot be identified, appeared in a children’s court on Monday charged with rape, stalking, false imprisonment, assault and reckless injury and was refused bail.

A woman was running on a trail in Jacana, north of Melbourne, on August 14 when a boy allegedly attacked her from behind, threw her to the ground and sexually assaulted her.

She managed to escape and ran to a car park, where two passers-by helped her and called police.

The court heard on Monday that DNA evidence taken from the woman’s clothing and body was forensically tested and matched the teenager’s DNA.

The boy’s lawyer argued that the teen should be released on bail after spending six days in custody.

The lawyer told the court: “Given that this was his first time in custody, the benefits of this approach and the fact that if he committed an offence and endangered the community he would be detained again.”

“This will further deter him from reoffending.”

The boy’s mother said he had dropped out of school before the alleged crime and she had tried to contact the school to ensure he was caught up with his studies but had not received a response.
