Deputy Mukash Ilsaliyev asked the Chairman of the National Security Committee to check the legality of filing a criminal case – Tazabek

Tazabek – Mukash Ilsaliyev’s lawyer asked the Chairman of the National Security Committee at a press conference of AKIpress on July 22 Kanchibeka Tashiyeva The Office of the Attorney General verifies the legality of criminal cases and detention.

Earlier on July 15, the National Security Committee announced the detention of Ilsaliyev on charges of occupying the Bereke market near the Dordoi shopping mall.

Lawyer Anatoly Safonov reported that Yrsaliev was detained after making a statement to Zh.N. The reason for the statement, as explained by the lawyer, was the alleged seizure of property of a small market of Dava Impex LLC. According to the lawyer, Yrsaliev and the applicant previously served together in the special forces of the Ministry of Internal Affairs and were both boxers.

Safonov reported that on December 15, 2014, Yrsaliev and Zh.N. signed a sale and purchase agreement for 62 containers on 8 acres of land for $600,000. Six months later, as Safonov explained, Zh.N. also signed a second agreement to exercise the right to lease a plot of land to Yrsaliev, as the plot belonged to the Bishkek Mayor’s Office. As Safonov said, the civil relationship between Yrsaliev and the applicant should be settled by the judicial authorities in a civil manner.

Lawyer Zhyrgalbek Babayev stated that there are no grounds for criminal prosecution, since the two concluded a civil sale and purchase agreement in 2014 and a lease agreement in 2015. Babayev also mentioned that the statement of Zh.N. was written 10 years later, while the period of criminal prosecution under Article 209, Paragraph 4 (“Fraud”) of the Criminal Code of the Kyrgyz Republic is 7 years. Babayev also stated that the jurisdiction under this article belongs to the Ministry of Internal Affairs, not the State Security Committee. The lawyer expressed the belief that the criminal case against Ilsaliev will be dropped due to the lack of criminal facts.
