On the other hand, the AT concluded that the District Court was motivated to conclude that the defendant was under an obligation to give truthful testimony. The District Court had determined that no administrative offence proceedings were instituted against him. Moreover, administrative offence proceedings and criminal proceedings are not initiated in relation to the same facts, but in relation to different factual circumstances and are two different, separable proceedings that must be evaluated in accordance with the general rules and fundamental principles of each procedure.
