The Constitutional Court confirmed the election results announced by the Independent National Electoral Commission, declaring Felix Tshisekedi as President of the Democratic Republic of the Congo.
The Constitutional Court analysed two appeals filed by Martin Fayulu and Theodore Ngoyi, both of which challenged the provisional results released by the National Electoral Commission last week.
In his petition, Fayulu called for the annulment of the provisional election results, a manual recount and a review of data collected by election observers from the National Episcopal Conference of Congo (CENCO) and other institutions that showed Martin Fayulu was the true winner of the presidential election.
Fayulu also said INEC violated the constitution by excluding four constituencies in North Kivu (Beni and Butembo) and Mai-Ndombe (Yumbi), which represent 1,359,000 voters.
He asked for an order to the Independent Electoral Commission to organize elections in those areas within two weeks and to delay the announcement of results until the results of the excluded constituencies were announced.
The Constitutional Court rejected Mr Fayulu’s request, saying he either failed to provide evidence of his allegations of fraud or that INEC had the power to annul the elections in Beni, Butembo and Yumbi. The Constitutional Court refused to recount the votes or to annul the elections, saying they were conducted under normal circumstances.
With the final results of the presidential election announced by the Constitutional Court, Felix Tshisekedi was elected President of the Democratic Republic of the Congo with a simple majority for a five-year term. He will become the fifth president of the Democratic Republic of the Congo. He will succeed Joseph Kabila, who has been in power since January 26, 2001.
According to the new election schedule, the new president will be sworn in on January 22. This will be the first peaceful transfer of power in the Democratic Republic of the Congo.
