The Council of State has issued its opinion on the municipal elections planned for this year. The jurisdiction announced in a letter to the Independent National Electoral Commission (CENI) on July 30 that the vote will be held before December 31, 2024, in compliance with the law.
The State Council also clearly stated that “ Pending formation of a government constitutes force majeure ”. This statement was made against the backdrop of the country going through a phase of political transition, marked by the recent creation of new legislative bodies following the election of the members of the Permanent Bureau and the Chairperson of the Commission.
The letter from the Council of State stressed that “ Time required to establish a new legislative body at the National Assembly level » It also constitutes a legitimate reason to maintain the election beyond the statutory period established by article 52 of Organic Law 2018-008 of May 11, 2018. It can be carried out without prejudice to the legality and legitimacy of the process.
CENI has proposed to postpone the vote to December 11 if it is initially planned for November 6. The terms of office of the mayor and aldermen expired on January 10, but according to the decision of the HCC, these local elected officials will be able to continue their activities until their successors arrive after the elections.
