European diplomacy chief Josep Borrell announced that the EU took note of the UN’s top court ruling that Israel’s 57-year occupation of the Palestinian territories is illegal, adding that the position is “largely in line with the EU’s position”.

The Hague-based International Court of Justice (ICJ) issued a wide-ranging opinion on the matter on Friday. Israel immediately called the verdict “a decision full of lies,” according to AFP.

However, in his statement on Saturday, Borrell called for support for Merck’s position, arguing that “in a world where international law is constantly and increasingly violated, we have a moral responsibility to reaffirm our unwavering commitment to always supporting all decisions of the International Court of Justice, whatever the subject of the dispute.”

Borrell added in his statement that the court’s opinion “requires a more thorough analysis, taking into account its impact on EU policy.”

The MSD’s decision is non-binding but comes amid growing concern about the death toll and destruction caused by Israel’s war against the Palestinian militant movement Hamas, which was sparked by an attack by Palestinian terrorist commandos on southern Israeli communities on October 7, 2023. There are also concerns about rising tensions in the West Bank.

According to AFP, the MSD ruling and its support from the EU is likely to increase diplomatic pressure on Israel over the war in the Gaza Strip.

Netanyahu: Jewish people are not occupiers

Israeli Prime Minister Benjamin Netanyahu condemned the MSD’s decision. In a statement, Netanyahu said, “The Jewish people are not occupiers of their own lands, neither our eternal capital, Jerusalem, nor our ancestral lands of Judea and Samaria” (the occupied West Bank).

Israel seized the West Bank and East Jerusalem, the Golan Heights from Syria, and the Gaza Strip and Sinai Peninsula from Egypt in the Six-Day War against its Arab neighbors in June 1967. He then began to settle in the 70,000 square kilometers of occupied territories.

The United Nations later declared the occupation of the Palestinian territories illegal.

Egypt regained the Sinai Peninsula under a 1979 peace agreement with Israel.

MSD said on Friday that Israel’s settlement policy and use of resources in the Palestinian territories violate international law; he called Israel’s continued presence in the Palestinian territories illegal and considered Israel’s occupation of those territories to be “de facto annexation.”

The independent opinion, prepared by MSD at the request of the UN General Assembly, also stated that Israel systematically discriminated against Palestinians in the occupied territories, which the court held violated the Palestinians’ right to self-determination.
