The Abu Dhabi Family, Civil and Administrative Claims Court ruled to dismiss a case filed by a person against another person in which he was asked to return a debt worth Dh70,000, and he relied on his conscience because he was instructed to make a decisive oath. He took the form prescribed by the court, according to which the court acquitted him.
Specifically, one person filed a lawsuit against another person for an obligation to pay him 70,000 dirhams in fees and expenses, with the ruling including immediate effect, on the grounds that the defendant had borrowed the money from him and had not returned it to him.
The supervising judge decided to give the decisive oath directly to the accused, so he took the oath before him, whereupon the judge decided to transfer the case to the competent authority.
The court explained in its judgment that the plaintiff filed the present lawsuit on the basis that he had lent the defendant 70,000 dirhams, but given the above circumstances, the plaintiff could not return it. In order to prove the validity of his claim, he requested a decisive oath to the defendant, and the judge approved his request, and then appeared in court on behalf of the defendant, expressed his willingness to take an oath and swear before the judge, and then proved to the court that the defendant had paid the value of the loan in question, which meant that the court could only decide to dismiss the lawsuit.
