In a press release from the Council of Ministers, we can see that the French Polynesian government expressed its “determination to protect the health of its inhabitants and prevent nicotine addiction and the harmful effects of smoking”.
As part of this commitment, the Department of Health is proposing to update laws governing the regulation of tobacco products to include e-cigarette devices in order to reduce access to these products and reduce the risk of dependence, particularly among young people.
Imports of customs codes containing e-cigarettes have increased fivefold since 2018. By aligning the legislative framework with technological innovation and limiting the risks associated with the consumption of new products, the authorities hope to strengthen the fight against smoking in French Polynesia.
Regulations and new measures
To better regulate tobacco products and e-cigarette devices, the new regulations plan to restrict e-cigarette products by banning disposable devices and limiting authorized flavors, adopt neutral packaging to reduce visual appeal, limit the nicotine content of these products as well as the capacity of tanks and refills to reduce the risks associated with their consumption, review the taxation of tobacco products, require licenses to import, manufacture and sell these products, oppose the marketing strategies of tobacco product manufacturers and restrict the communication around these products and identify specific areas of their consumption.
These measures will make the market more regulated while guaranteeing consumer safety. They will also allow the authorities to monitor the professionals involved in the process and guarantee compliance with established standards.
Finally, strict controls and sanctions will be imposed to regulate activities in this area, ensure compliance with the regulations and prevent abuse.
Apply in early 2025
The bill was developed in conjunction with the relevant domestic service sectors. An external consultation phase, including key players in the economic and health sectors, will last until the end of August to collect their opinions. The new law is scheduled to enter into force in early 2025.
