Kabale High Court Justice Samuel Emokor sentenced Brian Tayebwa, 30, to 10 years’ imprisonment for aggravated robbery after he pleaded guilty.
The prosecution, led by Noeline Nagayi, told the court that Brian Tayebwaday In 2020, Maureen Komuhangi was intercepted in the Bushoro Kabale area and a bag containing a mobile phone, UGX450,000, cash, UGX112,000, shoes, a dress Lesu, cosmetics, a scarf (totally worth UGX2.1 million) and the keys to her house were snatched from her in violation of Sections 285 and 286(2) of the Criminal Code.
Nagayi further told the court that at about 7pm, Komuhangi was returning from Nyabikoni in Kabale Municipality after prayers and when she reached Bushuro, Taibwa was riding a motorcycle with another person and when they arrived, they stopped and Taibwa pulled out a machete from the motorcycle and grabbed her by the neck, threatening to kill her if she called the police, at which point another colleague who was riding the motorcycle with him snatched the bag she was holding and after the robbery, they sped away.
When the charges were read to him by Taibwa’s lawyer, Alice Namara, he admitted them and pleaded for leniency, saying he was remorseful for what he had done.
Judge Emokor said Taibwa himself pleaded guilty to aggravated robbery.
Nagayi told the court that the convict did not waste time but pleaded guilty at the earliest opportunity and did not waste the time and resources of the court, but the crime he committed was a serious crime punishable by death, noting that such cases are rampant within the jurisdiction of the court, she asked the court to impose a deterrent sentence on the convict, Brian Taibwa, so that other people who might commit crimes would be aware.
She also asked the court to order the convict to return the looted items from the victim valued at Uganda Shs2.1 million as the items have not been recovered yet.
Justice Emokor then sentenced him to 10 years in prison, but after deducting the time he had already spent in custody, which was four years and two months, he still had to serve five years and four months, and ordered him to pay Komuhangi Ugx. $1.5 million in compensation for the value of the property and money stolen from him after serving his sentence.
