The judge dismissed the claim of German company ThyssenKrupp Marine Systems (tkMS). Today, the District Court in The Hague ruled on tkMS’s objection to the (provisional) decision of the Ministry of Defence to award the French company Naval Group the construction of four submarines.

The award was approved by a wide majority in the House of Representatives in mid-June.

The delivery contract between the Ministry of National Defence and Naval Group is expected to be signed after the summer. Before it is signed, the Dutch and French governments must first sign an agreement. This so-called memorandum of understanding stipulates, among other things, that the Netherlands can use and maintain the purchased items independently of Naval Group and the French government.
Prior to the signing of the delivery contract, an industrial cooperation agreement was also signed. The Ministry of Economic Affairs and Climate (EZK) is working with Naval Group on this issue. The agreement guarantees the participation of Dutch industry.
Killer whales, swordfish, barracuda and tiger sharks
Naval Group will deliver HMS Orca and HMS Swordfish within 10 years from the date of the contract. Next will be the other submarines HMS Barracuda and HMS Tigershark. The Orka class gives the Navy’s submarine force an edge in future underwater warfare.
