A South African woman who ended her marriage after discovering her husband was having an affair with her best friend is seeking more than $5,400 in monthly maintenance and $9,250 for new furniture. The case was brought to the Durban High Court under a Rule 43 application seeking interim maintenance for herself and their three children until the divorce is finalised.
In the application, the wife claimed that the husband was a financially well-off surgeon at Umhlanga Netcare Hospital and could afford the requested amount. She stressed that the husband had a good income, owned a laparoscopy clinic, and was a trustee of two trusts and a director of three companies. In addition, she believed that he may have invested up to $51,000 in cryptocurrencies.
Their marital home is valued at approximately $540,000, and the husband drives a car valued at at least $54,000. According to court documents, the wife moved out of their home in March 2024 and now lives with her brother. She left after learning that her husband was having an affair, which seems likely to lead to a polygamous marriage.
In his response, the husband stated that he made just over $4,200 per month and could only afford $320 in child support. He promised to cover the children’s education, medical and dental expenses and maintain his estranged wife’s medical assistance insurance. However, he did not respond to his wife’s allegations, but instead detailed their marital problems since 2014.
The judge noted that the husband’s arguments were of little help in the application of Rule 43. Therefore, the court ordered him to pay $2,950 per month in alimony, cover the medical and educational expenses of all the children, and pay $9,250 to buy new furniture for his wife. In addition, he must pay $2,200 as divorce expenses to his wife by the end of July.
