The La Paz Provincial Court denied, without a hearing, the popular action filed by a group of La Paz citizens to protect the Isiboro Secura Indigenous Territory and National Park (TIPNIS) and against the government’s construction consultation Carlos Derpic, lawyer for the appellants, reported that construction work had been carried out on the second section of the Villa Tunari-San Ignacio de Moxos highway, in the middle of the ecoregion, without prior consent.
Delpic explained that the court justified the ruling by not providing a list of facts, did not indicate which rights were violated and did not call for preventive measures, even though every right was mentioned in the support provided in the popular action.
“They say they haven’t achieved it yet: one, two, three; so it’s rejected from the beginning and when you see the actions of the people, one, two, three are there,” the professional told the El Boer Aboriginal News Agency.
After the results came out, it was decided to challenge the popular lawsuit at the Plurinational Constitutional Court (TCP), and Derpic did not rule out filing a lawsuit with an international organization once actions at the national level have been exhausted.
“When state action is exhausted and rights are not protected, as in Bolivia, you can follow the procedure to bring a TIPNIS case to the Inter-American Commission on Human Rights or the Inter-American Court of Human Rights, because the environment is a collective right,” he noted.
