Man sentenced to 13 years for rape and sexual assault

The High Court in Suva has sentenced a man to 13 years and 11 months in prison for multiple offences of sexual assault and rape.

The accused appeared before High Court Judge Pita Bulamainaivalu on Wednesday.

The man was convicted of three counts of sexual assault, contrary to section 210(1)(a) of the Criminal Code 2009, and two counts of rape, contrary to sections 207(1) and 2(b) of the Criminal Code 2009.

It is alleged that he committed unlawful and indecent acts on the victim between June and December 2020 in Naikawaga village in Tailevu Municipality in the Eastern Region.

He allegedly sexually assaulted the victim without her consent between January and December 2018 in Naikawaga village in Tailevu Municipality in the Eastern Region.

The court heard that the defendant voluntarily pleaded guilty to all five charges.

Justice Bulamainawalu said that in accordance with Section 18 of the Sentencing and Punishment Act 2009 and the Supreme Court’s decision in Timo v State (2019) FJSC 22; CAV0022.2018, the minimum sentence or non-parole period is 12 years.

The suspect has 30 days to appeal the verdict.
