Santiago, Dominican Republic – The First Chamber of the Criminal Division of the Court of Appeal of this Judicial District dismissed the appeal of the technical defense and approved the three-month preventive detention imposed by the Court of Permanent Attention on a football coach. The Santiago Prosecutor’s Office investigated and filed charges for the creation, production and distribution of child sexual abuse video content.
The plenary session that constitutes the Court ruled against the accused Celso Manuel Portela Álvarez, because the assumptions that led to the adoption of the coercive measure had not changed and the crimes alleged were extremely serious.
The Santiago Public Prosecutor’s Office, following several months of investigation in coordination with the Special Prosecutor’s Office against High-Tech Crimes and Crimes (Pedatec), determined that Portela Álvarez faces provisional charges for violations of article 24 of Law No. 53-07 on High-Tech Crimes and Crimes, as well as articles 25 (paragraph III), 26 and 411 of Law No. 136-03 establishing the Code of Protection and Fundamental Rights of Boys, Girls and Adolescents, concerning the creation, production, dissemination, access and possession of material containing child sexual abuse content (child pornography).
In addition, the defendant also violated the minors’ right to portrait, privacy, honor and dignity.
During the hearing, court attorney Alba Aires Rojas refuted the technical defense’s allegations as baseless.
In reaching its ruling, the court weighed the strength of the evidence and the seriousness of the charges brought by the public ministry against the coach, who owns a football academy for school-age children.
During the hearing, the Public Ministry defended the relevance and appropriateness of the preventive detention of the accused, as it posed a potential danger to any child or young person.
The investigation, led by Lía Collado, the Electronic Crimes Prosecutor of the Santiago Prosecutor’s Office, was carried out through the Internet Child Online Protection Services (ICACCOPS) system, through which the defendant was observed sharing and downloading material containing sexual abuse and the rape of minors.
