(Daily Xianna) – If Tan Sri Muhyiddin is found to have violated any of the three sections of the Penal Code or the Sedition Act, his Pagoh parliamentary seat could be stripped from him.

In this regard, lawyer Mohammad Hanif Khatri Abdullah said that the police need to first investigate and consider the following aspects.

“Firstly, police need to investigate whether the statements are true.

“Secondly, whether the statement was intended to undermine the credibility of the royal institution was also considered.

“Third, whether this is regarded as the professional opinion of those in the relevant field, or Muhyiddin’s personal opinion without any intention to distort the facts,” he said in an interview with Sinar Harian on Monday.

Hanif further elaborated that if the police find reasons for further investigation, they will submit the investigation files to the prosecutor’s office.

“Then, if the prosecutor’s office finds that there is sufficient probable cause to bring charges to court, it will proceed with the charges.

“If the court finds him guilty, it could affect his position as a member of Parliament.

He added: “If the fine exceeds RM2,000 or the jail term exceeds one year, the representative will lose his membership under Article 48 (1) of the constitution.”
