Polish billionaire Rafal Brzoska and his wife plan to sue Meta for running fake ads on Facebook and Instagram that featured his face and spreading false information about her on the social media platform.
Brzoska said they had not yet decided in which jurisdiction to file the lawsuit, which would be one of a series of attempts around the world to hold the internet giant responsible for ads that keep appearing even after users notify the company of problems.
A Meta spokesperson said the company removes false ads from its platform as soon as it discovers them and works with local authorities to crack down on scammers.
Brzoska, founder of Polish parcel locker company InPost, said he informed Meta of the problem in early July but was unable to find a solution.
“We plan to file a private lawsuit against Meta… We have not yet determined in which jurisdictions we will sue Meta. We will make a decision in the coming weeks,” Brzoska told Reuters.
He added: “We are considering all possible scenarios, including litigation in the United States if Europe does not act.”
Brzoska said he and his wife would ask Meta to stop profiting from promoting content that infringes on their rights and to donate a large sum of damages to charity, an amount equal to the level of advertising revenue it earned from spreading such false information.
Last week, the Director General of the Personal Data Protection Office ordered Meta Platforms Ireland Limited to stop displaying fake ads using real data and images of Brzoska and his wife on Facebook and Instagram in Poland within three months.
“Scammers use every platform available to defraud people and continually adapt their tactics to evade capture,” a Meta spokesperson said in an emailed statement. “Scammers violate our rules and we remove them when we discover them.” He also said the company is evaluating the office’s decision.
“We also work with businesses, local governments and law enforcement to take down these criminals.”
