Doctor ordered to help parents raise newborn baby after mistake
The doctor was ordered by a court to pay millions of Colombian pesos to take care of the child of one of his patients because he assured her that the vasectomy was a success, so she did not use any other contraceptive method because she felt it was the end of the pregnancy.
However, it didn’t work because just one year after the treatment, the man was surprised to see his wife was pregnant, resulting in the family having an unexpected child.
Because it was beyond the family’s expectations and incomprehension, they had to conduct a medical examination, checked the man’s sperm, and found that he was still capable of getting pregnant, confirming that the vasectomy was wrong.
Although it took a long time, as the man had a vasectomy in 2012, the parents adopted the doctor in 2023, saying his mistakes had caused them medical and psychological problems.
The judge in the case decided that the doctor should help the family raise the child born as a result of his mistake until he is at least 18 years old.
The court’s ruling on the case stated that “taking into account the unforeseen circumstances, the patient does not need to continue to use other family planning methods, and it is revealed that the parents have confirmed that they do not wish to continue to have more children. Therefore, it was concluded that having another child had affected the family business, especially since the father of the child was unable to work due to a chronic disease.
According to OddityCentral, the child’s father is said to have hearing loss issues and is sometimes deaf and sometimes not, thus not allowing them to employ him as a worker.
That’s one reason why the judge concluded that doctors who cause a child to be born in a way not planned by the parents must defend themselves.
The court concluded that the doctor must pay 92 million Colombian pesos (about $20,000) in damages to the family, as well as 60 million pesos (about $13,000), court costs, and all other expenses the family spent in the case, totaling 143 million pesos ($31,000) to help the child who was born as a result of the doctor’s mistake.
What is interesting about the court decision is that, as the story states, the doctor no longer has to care for the child for the full 18 years, since he was born in 2013 and is now in his teens, which means he will be caring for him for the remaining years until he reaches the age of 18 as stated in this court decision.
There has been no explanation as to why the child’s family is suing the doctors over the delay.
