When civil servants are currently required to submit income declarations, is the right to confidentiality of personal deposits and savings stipulated in the Kazakh Constitution violated? The Constitutional Court reportedly answered this question Tengri News Network.

A citizen filed a request with the Constitutional Court to verify the constitutionality of articles 630 and 633 of the Tax Code.

Kazakhstan considers that these provisions, requiring him to submit a declaration of assets and income upon cessation of public service, violate the constitutional right to confidentiality of personal deposits and savings guaranteed under article 18, paragraph 2, of the Constitution.

“The obligation to submit a statement does not restrict the right to privacy of personal deposits and savings,” the Constitutional Court said in its commentary.

Thus, the Constitutional Court did not determine acceptable conditions for checking compliance with the Constitutional rules regarding the obligation of citizens to submit income declarations upon cessation of public service.
