Tegucigalpa – The Constitutional Chamber of the Supreme Court (CSJ) declared admissible the appeal filed by the National Autonomous University of Honduras (UNAH) against the Special Development Zone (ZEDE).
In this sense, the Constitutional Court declared Article 34 “EX NUNC” unconstitutional, namely by its origin, which means that its effect is retroactive.
The resolution considers that they have violated the exclusive powers of the Constitution of the Republic. In its ruling, the Court declared unconstitutional article 34 of Decree No. 120-2013, which contains the ZEDE Organic Law approved by the National Assembly on June 12, 2013.
According to UNAH Attorney General Aída Romero, Article 34 details violations of several articles of the Constitution, especially those related to higher education.
Article 160 of the Constitution gives UNAH exclusive powers to organize, direct and develop higher and vocational education in the country. However, article 34 of the ZEDE Act allows these regions to implement their own educational and curriculum policies at all levels and stipulates that the exercise of profession within the ZEDE is not conditional on membership or association.pound
